Official Rules, Terms & Conditions for the Guitos Big Joy Drop™ Game

What is This?

Welcome to the Guitos Big Joy Drop™ Game! This is a social media-driven, treasure hunt-style marketing promotion brought to you by Guitos LLC. This is a lifestyle brand sweeping the nation, all about fashion apparel and products featuring unique hand-drawn art and positive vibes, aimed at spreading more joy in the world.

Starting on or around July 3, 2025, special envelopes containing "treasure" will be hidden in public locations (and select privately-owned public spaces, with prior approval, such as shopping malls or privately-owned parks open to the public) across the Greater Boston region (within 40 miles of Boston). The first eligible individual to find a "Big Joy Drop" and follow the instructions inside will win a bundle of prizes. These prize bundles will vary in total approximate retail value, ranging from $100 (common drops) to $500 (rare drops).

Each prize bundle will include, at a minimum, instructions to claim:

  • One (1) Visa/Mastercard prepaid digital/virtual card valued at $50 or greater.

  • One (1) promotional Guitos.shop credit valued at $50 or greater.

  • Possibly one (1) item or service of value provided by a participating partner business.

Drops are expected to continue throughout Summer 2025, though they may extend past this date. Guitos LLC reserves the right to modify or terminate the promotion at any time without prior notice.

How to Participate

Participating is easy and fun!

Follow Guitos LLC on Social Media: Individuals should follow Guitos LLC’s official social media accounts for announcements, updates, and especially video and other clues pertaining to the next drop location.

No Purchase Necessary: There is absolutely no purchase or entry fee required to participate in the game. Purchasing Guitos LLC products will not provide you with any extra advantage related to the game.

Eligibility

To be eligible to participate and claim a prize:

  • Age Restrictions: You must be 18 years of age or older at the time of finding a drop. Individuals under the age of 18 are welcome to participate collaboratively in the treasure hunt if and only if they are accompanied and approved by a parent/guardian or other responsible family member who is 18 years or older. In such cases, only the legal adult will be eligible to officially find, agree to the terms, and claim prizes.

  • Proof of Identity & Age: To claim prizes, proof of identity—specifically, a current state-issued ID or license, or a current U.S. Passport—will be required via email. This is simply to verify your legal age and home mailing address.

  • Residency: You must be a legal resident of the United States.

Privacy and Information Use

  • Agreement to Terms: Upon claiming a winning drop, the eligible participant will be required to review and explicitly agree to all terms and conditions found here, as well as any additional terms detailed on the specific winning finder claim and consent page.

  • Data Collection & Marketing Consent: By claiming a prize, you consent to your personal identifying information (including your full legal name, home address, email address) being added to the Guitos LLC customer database and email list. This information will be used for future marketing purposes and other uses as detailed in the Guitos LLC Privacy Policy, which can be found here: https://guitos.shop/pages/privacy-policy. This policy provides all relevant information on how your private information is collected, used, stored, and shared.

  • Use of Winner Likeness: In claiming prizes, you agree that Guitos LLC, its partners, affiliates, and assigns may use your provided winner information (excluding, of course, sensitive information like your beautiful ID photo or home address) in future marketing materials. This includes, but is not limited to, usage on our website and in social media content. Similarly, participants and winners grant Guitos LLC permission to use and repackage content they share on social media platforms related to this treasure hunt game (e.g., names, likenesses, social accounts/handles, photos, videos, quotes). This usage may be perpetual and will not require any further compensation to the winner, their relatives, or representatives by Guitos LLC.

Drop Locations and Safety

  • Safe Placement: When an envelope is hidden, the location will always be a relatively safe and accessible area. Examples include: on a lamp pole on a sidewalk, or on a bench in a public park. Envelopes will not be placed in or around dangerous areas such as unsecured bodies of water or within active construction zones.

  • Your Safety is Key: All searching activities must be conducted in a smart, safe, and courteous manner. For instance, do not search in the dark. Guitos LLC is not responsible for any personal injury or property damage incurred during your search for a drop.

  • Environmental Factors: Please be aware that due to weather elements or wildlife, an envelope may move from its initial hiding place. For example, an envelope might detach from a brick wall and be carried by wind into a roadway. 

  • At all times: Be safe, be smart, be kind, and do not break any laws.

Simultaneous Searchers Finding a Drop

Guitos LLC assumes zero responsibility for any situations where a drop envelope is discovered by two eligible participants at the exact same moment. We will not be involved in resolving possible conflicts between participants. In such instances, these individuals may wish to discuss a private arrangement wherein one eligible person goes through the official claim process and is declared the official winner, with the prizes later split or shared in some mutually agreeable manner between the parties. Only one official claim will be processed per drop. Again, be kind and share joy.

Winning Claim, Prize Redemption, and Delivery Timelines

  • Claim Window: An eligible participant will have five (5) days from the date/time the drop envelope is put into its hiding place to visit the appropriate claim webpage, agree to these terms and conditions, and provide proper identification and information (name, email, home mailing address) to receive their prizes. After this time period expires, this drop will be considered abandoned, null and void.

  • Prize Delivery: Guitos LLC will review the provided information and email/mail/otherwise release prizes to the verified winner as quickly as possible. We appreciate your patience!

No Cash Value

Drop package prizes cannot be redeemed or exchanged for cash.

Limits to Winning

There can only be one winner per household, per calendar year.

Tax Ramifications

Winners are solely responsible for all taxes, if any, that may be due on awarded prizes. Guitos LLC will not provide tax or other professional advice and strongly encourages you to seek professional advice if necessary.

No Endorsements

These giveaways are not sponsored, endorsed, or administered by any social media platform, including but not limited to Instagram, TikTok, and Facebook.

Hold Harmless and Liability Release

By choosing to participate in this treasure hunt activity, all participants and winners agree to release, indemnify, and hold harmless Guitos LLC, its members, officers, directors, employees, agents, affiliates, and participating partner businesses (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever. This includes, directly or indirectly, those arising out of or related to any loss, damage, injury, or death that may be sustained by the participant or any third party, or any loss or damage to property belonging to the participant or any third party, whether caused by the negligence of the Released Parties or otherwise, while participating in the treasure hunt activity.

This release includes, but is not limited to, risks associated with physical activity, travel, interaction with other participants, and the discovery or handling/mishandling of any items related to the treasure hunt. Participants assume all risks associated with participation.

Dispute Resolution

All decisions made by Guitos LLC regarding the interpretation of these Official Rules, the conduct of the promotion, and the eligibility of participants and winners are final and binding in all matters relating to this promotion and cannot be appealed.

Force Majeure

Guitos LLC shall not be liable for any failure to perform or delay in performing its obligations under these Official Rules if such failure or delay is caused by circumstances beyond its reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Governing Law

These Official Rules, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Severability

If any provision of these Official Rules, or the application thereof to any person or circumstance, is found to be invalid, illegal, or unenforceable, the remainder of these Official Rules and the application of such provision to other persons or circumstances shall not be affected thereby and shall remain in full force and effect.
