California Proposition 65: What You Need to Know

California's Proposition 65 (The Safe Drinking Water and Toxic Enforcement Act of 1986) is a unique law requiring businesses to provide warnings about significant exposures to chemicals that the state of California has identified as causing cancer, birth defects, and/or other reproductive harm.

Purpose: Prop 65 aims to inform Californians about exposures to listed chemicals, allowing them to make informed decisions. It does not ban the sale of products containing these chemicals, but mandates a warning if exposure levels are above certain thresholds.

Applies Broadly: This law applies to all retail, mail order, and Internet sales of products to customers in California, regardless of where the business is located.

The List: The California Office of Environmental Health Hazard Assessment (OEHHA) maintains and regularly updates the Proposition 65 list. As of mid-2025, there are over 1,000 chemicals on this list.

Warnings: A Proposition 65 warning means a product may expose consumers to a listed chemical above a specific level set by California. It does not necessarily mean the product is in violation of federal safety standards or is inherently unsafe.

Safe Harbor Levels: OEHHA establishes "Safe Harbor Levels" (No Significant Risk Levels for carcinogens and Maximum Allowable Dose Levels for reproductive toxicants) for many chemicals. If exposure is at or below these levels, no warning is required. However, many chemicals do not have established Safe Harbor Levels, making compliance complex.
