What is Proposition 65?
California's Proposition 65 (officially the Safe Drinking Water and Toxic Enforcement Act of 1986) is a unique "right-to-know" law that applies only to the State of California. It requires businesses to provide warnings about significant exposures to chemicals that California has identified as causing cancer, birth defects, and/or other reproductive harm.
Why are you seeing this warning if you don't live in California?
As a business that sells products across the United States, it's often not practical to label products differently for each state. To ensure compliance with California law for any products that might be sold to or end up in California, we may apply Proposition 65 warnings to all our products, regardless of their final destination. This is a common practice for many businesses selling nationwide.
Does this mean the product is unsafe or violates federal standards?
No. A Proposition 65 warning does not mean that a product is unsafe, defective, or in violation of federal product safety standards. All Guitos LLC products are designed and manufactured to meet or exceed all applicable federal safety regulations.
The law simply requires a warning if a product might expose an individual to a listed chemical above very low, specific thresholds set by California. Many of these chemicals are commonly found in everyday items, some even occurring naturally.
What does this mean for you?
